Congress passes student loans, highway jobs bill

(AP) ? Finding rare political accommodation on the cusp of a holiday recess, Congress passed legislation Friday designed to salvage 2.8 million jobs and shield students from a sharp increase in loan interest rates.

The legislation, which also revamps highway and transit programs and shores up the federal flood insurance program, now goes to the White House for President Barack Obama's signatures.

Lawmakers trying to leave town for a weeklong Fourth of July recess had been facing twin deadlines: Federal highway and transit aid programs and the government's authority to levy federal fuel taxes were expiring Saturday. And interest rates on new student loans were set to double on Sunday.

The burst of legislating came just four months before the November elections, giving lawmakers achievements to show off to voters who have increasingly held Congress in low esteem while the economy continues to flounder.

"We have a bill that will boost this economy. We have a bill that is supported by conservatives and liberals, progressives and moderates. I think it's a great day," said Sen. Barbara Boxer, D-Calif., who led Senate negotiations on the transportation portion of the package.

Boxer estimated the bill would save about 1.8 million jobs by keeping aid for highway and transit construction flowing to states and create another 1 million jobs by using federal loan guarantees to leverage private sector investment in infrastructure projects.

Rep. John Mica, R-Fla., chairman of the Transportation and Infrastructure Committee, said: "Probably millions would have been put out of work if we hadn't acted."

Not all lawmakers were happy.

"At least it's not as bad as our Republican colleagues wanted," complained Rep. Earl Blumenauer, D-Ore., who has championed bike and pedestrian programs that the measure would squeeze. "But make no mistake, it is not a bill to be proud of."

In the bargaining that led up to an agreement on the package earlier this week, House Republicans gave up their demands that the bill require approval of the contentious Keystone XL oil pipeline and block federal regulation of toxic waste generated by coal-fired power plants. Democrats gave ground on environmental protections and biking, pedestrian and safety programs.

The bill consolidates various transportation programs and reduces the number of programs by two-thirds. States would have more flexibility on how they spend transportation aid. It also revamps rules on environmental studies of the potential impact of highway projects, with an aim toward cutting in half the time it takes to complete construction projects. And the measure contains an array of safety initiatives, including requirements that would make it more likely passengers would survive a tour bus crash.

"It doesn't have everything," Mica said. But "we were able to do more with less and move transportation for the nation forward."

The bill would spend about $100 billion on federal highway programs over two years, but puts off the politically tricky decision on how to pay for them after that.

The federal 18.4 cent-a-gallon gasoline tax and 24.4 cent-a-gallon diesel tax are no longer enough to pay for current spending on highway and transit programs. And two commissions and an array of private sector experts have said the U.S. should be spending about twice as much or more on its transportation infrastructure as it does now.

But Congress and the White House have refused to discuss raising fuel taxes or an alternative long-term source of money. The federal trust funds that pay for highway and transit programs are forecast to be nearly broke by the time the bill expires.

"When the bill expires we face a high cliff from which the program could fall," said Erich Zimmerman, a policy analyst with Taxpayers for Common Sense.

The fuel taxes are not indexed for inflation and haven't been increased since 1993, so their buying power has steadily eroded. Also, cars and trucks today are more fuel-efficient and the number of miles driven has flattened, resulting in less gas tax revenue. Since 2008, Congress has three times dipped into the national general treasury to borrow a total of $34.5 billion to keep transportation programs going.

Congressional bargainers reached an agreement earlier this week on the $6 billion college loan portion of the bill that would avert a doubling of interest rates beginning Sunday on federal loans to 7.4 million students. The current 3.4 percent interest rate on subsidized Stafford loans would balloon back to 6.8 percent on Sunday under a cost-saving maneuver contained in a 2007 law.

About $20 billion of the measure's cost is paid for by making changes in companies' pension calculations that will reduce their tax deductions, and increasing the payments businesses must make to insure their pension programs.

The bill also extends the federal flood insurance program to protect 5.6 million households and businesses. It addresses a shortfall arising from claims after 2005's Hurricane Katrina by reducing insurance subsidies for vacation homes and allowing for increases in premiums.

The measure also requires that 80 percent of fines for violations of the Clean Water Act as a result of the 2010 Deepwater Horizon oil spill in the Gulf of Mexico will go to a trust fund for Gulf Coast states damaged by the spill.

HBT: Oswalt impressive in Rangers debut

Roy Oswalt was a little shaky in his recent minor league tuneup starts, posting a 5.87 ERA over 15 1/3 innings between Double-A Frisco and Triple-A Round Rock, but he rendered any concerns meaningless last night.

Oswalt was very impressive in his Rangers? debut, allowing just one run over 6 1/3 innings as part of a 4-1 victory over the Rockies. It was his first start in a major league game since Game 4 of the NLDS against the Cardinals last year. The 34-year-old right-hander scattered nine hits while striking out six and walking just one. He didn?t allow a run until his 110th and final pitch of the evening via an RBI double by Marco Scutaro in the top of the seventh inning.

According to Brooks Baseball, Oswalt?s fastball topped out at 93.1 mph and averaged 91.5 mph, which was nearly identical to his average velocity last season with the Phillies. However, that?s still a tick below his career average of 92.9 mph. It will be interesting to see how Oswalt fares in his first go-around in the American League, especially coming off a season where he posted his lowest strikeout and swinging strike rate of his career, but he should be a stabilizing force for a rotation which has already battled numerous injuries and features a rookie pitcher, Yu Darvish, who is trying to find his way in his first season stateside.

(AP) ? President Rafael Correa's objections to what he deems American interventionism in Latin America and his delight in Julian Assange's massive uncorking of U.S. secrets appear to have persuaded the WikiLeaks chief that Ecuador offers his best shot at avoiding extradition to Sweden.

But four days after Assange ducked into Ecuador's London embassy seeking political asylum, this South American nation's leftist leader has yet to announce a decision. The choice may not be easy.

Correa was cagey on Thursday night, telling reporters that Ecuador was consulting with the other governments involved.

"We don't wish to offend anyone, least of all a country we hold in such deep regard as the United Kingdom," he said.

The question he faces is whether it's worth risking a backlash from Washington and the European Union against his small, petroleum-exporting nation of 14 million.

On the plus side, Correa would deepen his anti-establishment reputation by identifying himself with someone who also rates the mainstream media as beholden to moneyed interests and powerful governments.

"By giving Assange asylum, Correa (would be) burnishing his anti-US credentials," said Michael Shifter, president of Inter-American Dialogue, a nonpartisan think tank in Washington, D.C. "Correa and Assange not only have a personal chemistry ? they also see themselves as victims of U.S. power."

The two seemed to get on well when Assange interviewed Correa last month for his Kremlin-funded TV program. "Your Wikileaks have made us stronger," Correa told Assange, adding later: "Welcome to the club of the persecuted."

"It is hard to escape the irony that Correa, who has suppressed press freedom in Ecuador, is associating himself with the professed champion of transparency," said Shifter. "What this reveals is that it all comes down to ideology."

Correa has angered human rights and media freedom activists by using criminal libel law and media ownership restrictions to gag opposition-owned outlets that he claims are corrupt and intent on destroying him.

The tactic hasn't hurt him domestically, however. The leftist economist who took office in 2007 is popular with lower-class Ecuadoreans who benefit from his generous public spending. His approval ratings top 70 percent.

Nor is Correa as relentlessly hostile to Washington as President Hugo Chavez of Venezuela. Unlike Chavez, he has never accused the U.S. of trying to overthrow him. But he does relish courting U.S. global counterweights including Russia, China and Iran.

And he boycotted April's Summit of the Americas in Colombia to protest Washington's continued insistence on excluding Cuba from such hemispheric summits.

Correa has also expelled three U.S. diplomats whom he considered threats, including an ambassador who suggested in one of the more than 250,000 U.S. diplomatic cables that WikiLeaks laid bare that Correa was deliberately overlooking high-level police corruption.

But none of that guarantees he'll grant the Australian activist refuge.

"The internal political and economic costs of asylum don't square up with the benefits," says Grace Jaramillo, an international relations expert at Ecuador's FLACSO university.

"We're in an election year in which a strangling of relations with European countries and the United States, with which we are, respectively, negotiating a trade agreement and the renewal of preferential tariffs, would give them a good excuse to stop negotiations," she said.

"Ecuador could basically forget about any renewal of the trade preferences if it granted safe haven to Assange," said Cynthia Arnson, Latin America director at the Woodrow Wilson center in Washington.

Forty-five percent of Ecuador's exports go to the U.S. and account for about 400,000 jobs. And a failure to reach a trade pact with the European Union could cut exports by 4 percent and cost tens of thousands of jobs.

There's also a risk for Correa of having Ecuador "become catalogued as a country that obstructs justice" and "protects transgressors of international law," said political scientist Vicente Torrijos of Rosario University in Bogota, Colombia.

That could cost him votes when he runs for re-election early next year.

On the other hand, he would win points with Latin American leftists for whom Assange is a "gigantic symbol" of the crusade against what they see as America's heavy-handedness in the region, said international relations specialist Sandra Borda of the Universidad de Los Andes in Bogota.

But she doesn't believe Washington would punish Ecuador if it accepted Assange. And in Washington, the State Department sought to keep out of the crossfire.

"This is a UK-Ecuador-Sweden issue," U.S. State Department spokeswoman Victoria Nuland said Wednesday. "We want to see justice served; let's leave it at that."

On the streets of Quito, some had only a vague notion of who Assange is.

One man who did know, 43-year-old lawyer Julian Amaya, didn't think bringing the former hacker to Ecuador was a good idea.

"It doesn't make sense," he said, "because who is going to guarantee that he doesn't do the same thing here: reveal the secrets of the government, or of the opposition or whomever he wished?"

Jury selection to begin for Saudi in US bomb plot

(AP) ? Jury selection is set to begin Thursday in the trial of a Saudi man accused of gathering bomb components with the intention of targeting sites across the U.S. including former President George W. Bush's Dallas home.

Khalid Ali-M Aldawsari, 22, a former Texas Tech University chemical engineering student, has pleaded not guilty to a charge of attempted use of a weapon of mass destruction, and faces up to life in prison if convicted. Attorneys plan to use an insanity defense, court records show.

Federal agents secretly searched Aldawsari's apartment in Lubbock, Texas, twice in the days leading up to his arrest in February last year. They say they found almost everything needed to build a bomb, including chemicals, beakers, flasks, wiring, a hazmat suit and clocks, which he had bought online in the previous months.

He had researched targets ? including dams, nuclear plants and Bush's Dallas home ? and how to place bomb material inside dolls and baby carriages, court records show.

They also discovered Aldawsari's journal, handwritten in Arabic, in which he wrote that he had been planning a terror attack in the U.S. for years, even before he came to the country on a scholarship, and that it was "time for jihad," or holy war, court documents show. He bemoaned the plight of Muslims and said he was influenced by Osama bin Laden's speeches.

U.S. District Judge Donald E. Walter, who is assigned to the case, ruled last week that prosecutors can use footage from videos found on Aldawsari's computer, including one in which Ayman al-Zawahri, al-Qaida's current leader, praises as martyrs two unspecified individuals killed by "American Crusaders." Two instructional videos that he also allowed show how to prepare the explosive picric acid and how to use a cellphone as a remote detonator.

The judge excluded a video containing an image of Osama bin Laden and audio believed to be a speech given by the slain al-Qaida leader and another file on that video that has graphic images of war that seem to focus on the Palestinian-Israeli conflict, according to court documents. Walter wrote that prosecutors could present it at trial and explain its relevance to him while jurors are out of the courtroom, documents show.

Aldawsari's attorneys said in court documents that the video "rolls everything that is unfairly prejudicial about the other videos into one." They also said Aldawsari had no contact with any terrorists.

TNP, the chemical explosive that Aldawsari was suspected of trying to make, has about the same destructive power as TNT. FBI bomb experts said the amounts in the Aldawsari case would have yielded almost 15 pounds of explosive ? about the same amount used per bomb in the London subway attacks that killed scores of people in July 2005.

Authorities say they were tipped to Aldawsari's online purchases by chemical company Carolina Biological Supply of Burlington, N.C., and shipping company Con-way Freight on Feb. 1, 2011. The chemical company reported a $435 suspicious purchase to the FBI, while the shipping company notified Lubbock police and the FBI because it appeared the order wasn't intended for commercial use.

Within weeks, federal agents had traced Aldawsari's other online purchases, discovered extremist posts he had made on the Internet and secretly searched his off-campus apartment, computer and email accounts and read his diary, according to court records.

Aldawsari came to the U.S. in October 2008 from Riyadh, Saudi Arabia, to study chemical engineering at Texas Tech. He transferred in early 2011 to nearby South Plains College, where he was studying business. A Saudi industrial company, which was not identified in court documents, was paying his tuition and living expenses.

Rock paintings showing farmers with cattle are found in the area, but putting precise dates on when they were painted is difficult. Now Julie Dunne of the University of Bristol, UK, and colleagues have discovered milk residue on pottery shards from the Takarkori rock shelter in the Libyan Sahara, in layers known to be between 7200 and 5800 years old.

"The Sahara was quite a bit greener then," Dunne says. "There were lakes, grasslands and a wide variety of animal life ranging from cattle to crocodiles and hippos."

Storing milk in pots suggests it was being cured into cream or yogurt, which the lactose-intolerant prehistoric people would have been more likely to be able to digest, says Dunne.

The findings are evidence that milk played an important role in the diet of the prehistoric inhabitants of the region and confirm that dairy farming emerged in this area long before crop farming and sedentary living (Nature, DOI: 10.1038/nature11186).

Structure of RNAi complex now crystal clear

ScienceDaily (June 20, 2012) ? Researchers at Whitehead Institute and Memorial Sloan-Kettering Cancer Center have defined and analyzed the crystal structure of a yeast Argonaute protein bound to RNA. This complex plays a key role in the RNA interference (RNAi) pathway that silences gene expression. Describing the molecular structure of a eukaryotic Argonaute protein has been a goal of the RNAi field for close to a decade.

"You can learn a lot from biochemical experiments, but to more fully understand a protein like Argonaute, it's useful to know where all of the atoms are and which amino acids are playing important roles," says Whitehead Institute Member David Bartel, who is also an MIT professor of biology and a Howard Hughes Medical Institute (HHMI) investigator. "Learning the Argonaute crystal structure is an important step in understanding the RNAi biochemical pathway and will be the basis for many future experiments."

The yeast Argonaute structure is described in the June 21st print issue of Nature.

In humans and most other eukaryotes, the RNAi pathway can reduce cellular protein production by reducing the proteins' RNA templates. By exploiting this pathway, scientists are able to knock down the expression of specific proteins and thereby determine their roles within the cell or organism. The RNAi pathway has also been of considerable interest for the treatment of human disease.

RNAi depends on two proteins, Dicer and Argonaute. Dicer recognizes double-stranded RNA (dsRNA), latches onto it, and chops it into pieces 21-23 nucleotides long. Argonaute recognizes the dsRNA bits, discards one strand, and uses the other as a guide. When a single-stranded RNA matches the guide RNA's sequence, Argonaute cleaves the targeted RNA, thereby preventing it from serving as a template for protein production.

To determine the structure of Argonaute, Bartel and graduate student David Weinberg partnered with Kotaro Nakanishi in Dinshaw Patel's lab at Sloan-Kettering. Although the team expected to solve the structure of Argonaute alone, they were surprised to find that the protein came along with small bits of RNA that were also observed in the structure. The incorporation of these RNAs had switched the protein into an activated state that contained a four-component active site, the identification of which solved a longstanding mystery of what constituted the "missing" fourth component. With the structure of this complex in hand, scientists now have a better understanding for how it works.

"Seeing the crystal structure of a eukaryotic Argonaute for the first time was very exciting -- it's such a large protein with a complicated topology and many moving parts," says Weinberg. "It's a really impressive molecular machine."

Study improves understanding of surface molecules in controlling size of gold nanoparticles

ScienceDaily (June 18, 2012) ? North Carolina State University researchers have shown that the "bulkiness" of molecules commonly used in the creation of gold nanoparticles actually dictates the size of the nanoparticles -- with larger so-called ligands resulting in smaller nanoparticles. The research team also found that each type of ligand produces nanoparticles in a particular array of discrete sizes.

"This work advances our understanding of nanoparticle formation, and gives us a new tool for controlling the size and characteristics of gold nanoparticles," says Dr. Joseph Tracy, an assistant professor of materials science and engineering at NC State and co-author of a paper describing the research. Gold nanoparticles are used in industrial chemical processes, as well as medical and electronics applications.

The bulkier the ligand, the fewer ligands can sit side-by-side -- leading to a smaller nanoparticle.

When creating gold nanoparticles, scientists often use organic molecules called ligands to facilitate the process. The ligands effectively bring gold atoms together in a solution to create the nanoparticles. In the process, ligands essentially line up side by side and surround the nanoparticles in all three dimensions.

The researchers wanted to see whether the bulkiness of the ligands affected nanoparticle size, and opted to assess three types of thiol ligands -- a family of ligands commonly used to synthesize gold nanoparticles. Specifically, the molecules bound to the gold nanoparticles are linear hexanethiolate (-SC6), cyclohexanethiolate (-SCy) and 1-adamantanethiolate (-SAd). Each of these ligands has a bulkier configuration than the last.

For example, picture each ligand as a slice of pie, with a gold atom attached to the pointed end. -SC6 looks like a very narrow slice of pie. -SCy is slightly larger, and -SAd is the largest of the three -- with the "crust" end of the pie wedge far wider than the pointed end.

The researchers found that the bulkiness of the ligands determined the size of the nanoparticles. Because fewer -SAd and -SCy ligands can line up next to each other in three dimensions, fewer gold atoms are brought together in the core. Therefore, the nanoparticles are smaller. -SC6, the least bulky of the thiolates, can create the largest nanoparticles.

"While we've shown that this is an effective means of controlling size in gold nanoparticles, we think it may have implications for other materials as well," says Peter Krommenhoek, a Ph.D. student at NC State and lead author of the paper. "That's something we're exploring."

But the researchers made another interesting finding as well.

When particularly small nanoparticles form, they tend to form at very specific sizes, called discrete sizes. For instance, some types of nanoparticles may consist of 25 or 28 atoms -- but never 26 or 27 atoms.

In this study, the researchers found that the bulkiness of the ligands also changed the discrete sizes of the nanoparticles. "This is interesting, in part, because each discrete size represents a different number of gold atoms and ligands," Tracy says, "which could influence the nanoparticle's chemical behavior. That question has yet to be addressed."

Roger Clemens found not guilty in perjury trial

After eight weeks, 46 witnesses, two dozing jurors and an estimated $2 million-$3 million spent in taxpayer money,?the Roger Clemens trial has finally come to a close.

The verdict: Not guilty on ?three counts of making false statements, not guilty on two counts of perjury and not guilty on one count of obstruction. The charges stemmed from testimony that Clemens made in February 2008, telling a Congressional committee that he had never taken steroids or HGH. Prosecutors also alleged that Clemens intentionally made false statements that misled investigators.

Clemens faced a maximum sentence of 30 years and a $1.5 million fine if he had been convicted on all six counts, but he instead made out better than Barry Bonds. The all-time career home runs leader was hit with one charge of obstruction ? but sentenced to no jail time ? in his own perjury case.

Both Clemens and Bonds will hit the Hall of Fame ballot for the first time this winter and it's likely that neither will walk away happy with the results. Whether you agree with their stance or not, Cooperstown's voters carry a much lower burden of proof when it comes to the evidence that both used performance-enhancing drugs during their careers.

But like Bonds, Clemens benefited from the reasonable-doubt standard that's applied in a federal courtroom. Despite staging an exhaustive trial, federal prosecutors were unable to build a convincing case. Nor were they able to defeat the doubts that the defense raised about the motives and integrity of former Clemens trainer Brian McNamee.

So that's that. While we'll argue forever about the merits of the nation's lawmakers getting involved with baseball's steroid era, Clemens has escaped the legal process with no major damage except for a sizable lawyer bill. Jack Osbourne Has Multiple Sclerosis


Jack Osbourne was recently diagnosed with multiple sclerosis, the 26-year-old reality star himself confirmed in a surprising revelation this weekend.

Just two weeks after he and fiancée Lisa Stelly welcomed daughter Pearl Clementine, Jack was dealt the shocking news, he revealed to People

Difficult as it is, he's opening up about the emotional ordeal.

"I was just angry and frustrated and kept thinking, 'Why now?'" Jack says. "I've got a family and that's what's supposed to be the most important thing."

Multiple sclerosis, often abbreviated as MS, is a disease that affects the central nervous system - the brain and spinal cord - and can cause problems with muscle control and strength, vision, balance, feeling, and thinking.

MS differs in each case, with some people going through life with only minor problems and others becoming seriously disabled by the condition.

Most people fall somewhere between those two extremes.

Hopefully in this case it's the former. We wish Jack Osbourne nothing but the best as he takes on this unexpected and formidable obstacle.
