Australia & New Zealand Banking settles on limit violations: CFTC

WASHINGTON (Reuters) - Australia and New Zealand Banking Group Ltd agreed to pay $350,000 to settle charges it violated position limits in the wheat and cotton futures markets, the U.S. Commodity Futures Trading Commission said on Thursday.

The financial services company exceeded limits in wheat futures trading on the Chicago Board of Trade on multiple occasions in August, 2010, the CFTC said.

The firm also surpassed position caps in cotton futures trading on ICE Futures US, which is owned by IntercontinentalExchange Inc. in February, 2011. The Chicago Board of Trade is owned by CME Group Inc.

The order was filed on Wednesday and is the latest in a flurry of position limits settlements announced by the CFTC in the lead-up to the October 12 effective date for new caps on the number of contracts that traders can hold in certain markets.

On Tuesday, the CFTC announced that a little-known Shanghai, China firm, Sheenson Investments Ltd, and its founder, Weidong Ge, had agreed to return $1 million in ill-gotten gains and pay a $500,000 civil penalty for exceeding federal limits on speculative bets in soybean oil and cotton futures.

Last Friday, the agency ordered Citigroup Inc and a subsidiary to pay $525,000 for violating limits in the wheat market.

The settlements come before a new set of trading curbs kicks in October 12. The rules, which aim to rein in speculation and limit price spikes, were included in the 2010 Dodd-Frank financial reform law and finalized by the agency last October. Additional caps are expected to kick in next year.

Financial industry groups have sued to stop the new position-limit rules from taking effect, saying they would irreparably harm the marketplace and that the CFTC failed to sufficiently weigh the economic consequences of the rule, as is required by law.

Traders and some Republican lawmakers have argued there is no evidence that speculators inflate prices.

A judge has not yet ruled in the case, which was filed by the Securities Industry and Financial Markets Association and the International Swaps and Derivatives Association in December.

Italian business greets prospect of 2nd Monti term

MILAN (AP) ? Italian business and church leaders on Friday warmed to the prospect that Premier Mario Monti might stay on for a second term, while politicians insisted the post must return to a political leader.

The head of the Confindustria business lobby Giorgio Squinzi said the primary concern was having a "solid, trustworthy government with credible people and that has a political base." He said Friday that a second Monti mandate "is one of the possibilities."

Monti hinted Thursday he could stay on for a second term under the right circumstances. Italy is heading to elections next spring, and experts say the failure of any party to win a clear majority could clear the way for another Monti mandate.

Fiat and Chrysler CEO Sergio Marchionne, speaking from the Paris Auto Show, said a continuation of Monti's administration "would be a step forward for the country," lending credibility and removing uncertainty.

Avvenire, the influential newspaper of the Italian Catholic bishops' conference, called Monti's declaration "a useful step, another service to the country" and a "strong signal to the parties in a moment of maximum loss of credibility in the political system."

Monsignor Mariano Crociata, secretary-general of the Italian Episcopal Conference, said "we favor any solution that could bring an adequate and speedy resolution to the crisis."

Monti is a devout Roman Catholic and has met with Pope Benedict XVI on numerous occasions since taking office.

Monti was tapped last November to head a government of experts to steer the country from financial disaster. His government has passed a raft of reforms aimed at cutting spending and waste and increasing competitiveness of the economy by weakening professional castes and streamlining bureaucracy. His nonpartisan standing has made it possible to get Italy's divisive politicians to back the measures.

He also has burnished Italy's image abroad, and has won the trust of German Chancellor Angela Merkel and President Barack Obama.

Monti has made it clear he will not run for office as it would only weaken his ability to push through reforms, and would only accept a second term only if asked by the parties after elections. The situation that favors a second Monti government would be the failure of any party to win a clear majority, "which is not unlikely," said James Walston, professor of political science at the American University of Rome.

A poll published this weekend in Corriere della Sera showed that about half of Italians ? disenchanted with persistent political scandals ? were undecided and planned not to vote.

If the major three parties split the vote and were forced by the election outcome to form a grand coalition, "that is a scenario that favors a second Monti term," said Roberto D'Alimonte, a political science professor at Rome's LUISS University.

The outcome will be influenced by a new electoral law that is being held up by disagreements over what percentage of a bonus the top-vote winner will get in an effort to solidify a majority in Parliament.

D'Alimonte also suggested that the markets could also force Italy's hand, if borrowing costs on Italy's enormous debt pile grow ? particularly in the period after elections when a government is formed.

"The markets vote, too, not just Italian voters," D'Alimonte said. "This is a time of mixed sovereignty.'

ACLU asks Supreme Court to reconsider gene patenting case

(Reuters) - The American Civil Liberties Union has asked for a second time that the Supreme Court invalidate Myriad Genetics Inc's patents on two genes associated with hereditary breast and ovarian cancers, the latest salvo in a case with broad consequences for the future of gene-based medicine.

The lawsuit against Myriad and the University of Utah Research Foundation, which hold patents that allow the company to control testing for the genes, alleges that the patents are illegal and restrict scientific research and patients' access to medical care.

The lawsuit was filed by the ACLU and the Public Patent Foundation on behalf of medical associations, geneticists, patients and breast cancer and women's health groups, the ACLU said on Tuesday.

The Supreme Court had sent back the ACLU's previous lawsuit to the U.S. Federal Court of Appeals in Washington, D.C. It asked the appeals court to reconsider an earlier decision upholding the patents in light of a March decision by the high court that rejected a similar case about a patented method for monitoring a patient's blood.

However by a 2-1 vote, the appeals court in August again ruled that companies can obtain patents on genes.

The Supreme Court is not required to take up the case and will likely first give Myriad a chance to respond before deciding whether to hear the case or let the appeals court ruling stand.

"In our view, the court of appeals did not fully consider or correctly apply the Supreme Court's most recent and relevant patent law decisions," ACLU attorney Chris Hansen said in a statement.

Myriad did not immediately return calls seeking comment on the ACLU action.

The genes in question, known as BRCA1 and BRCA2, can be used to detect risk of breast and ovarian cancer and to help inform treatment options. Women who test positive using Myriad's gene test, called BRACAnalysis, have an 82 percent higher risk of developing breast cancer and a 44 percent higher risk of ovarian cancer in their lifetimes.

The patents give Myriad exclusive rights to perform tests on the two genes. The ACLU suit argues that the exclusivity allows Myriad to set the cost of such testing and makes it impossible for women to access tests that provide more comprehensive information about their genes or get a second opinion about their results.
